Terms And Conditions

1. Description of Promotion

Welcome to the Feel The Heat promotion (the “Promotion”), where participants receive a Twenty-Five Percent (25%) deposit match up to Seventy-Five ($75) Bonus Credits. Participants must deposit and wager One Hundred Dollars ($100) or more to qualify.

2. Promotion Period

The Promotion will begin on May 30th, 2024 at 12:00am ET and end on June 2nd, 2024 at 11:59pm ET (the “Promotion Period”).

3. Eligibility

The Promotion is only open to individuals who are at least 19 years of age and are physically present in Ontario during the Promotion Period. Self-excluded individuals are ineligible. Employees, officers and directors of the Mohegan Digital, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Promotion Bonus (as defined below).

4. Action Required

Make one (1) or more deposit(s) during the Promotion Period of at least One Hundred Dollars ($100) into your Account (as defined below) (collectively the “Promotion Requirements”). Once completed, you must make one or more wagers totaling a minimum of One Hundred Dollars ($100) of real cash funds on casino games. Bonus credits will be applied to eligible players on Monday, June 3rd. A 6X wagering requirement, as defined herein, shall apply to any bonus funds issued as part of this promotion. If you are opted into 2+ promotions with deposit requirements, your deposits will count towards the first opted-in promotion until completed. Please make at least one (1) deposit to satisfy the Promotion Requirements.

5. Claiming Promotion Offer

Upon satisfying the Promotion Requirements, you will receive Bonus Credit equal to Twenty-Five Percent (25%) of your total deposit amount during the Promotion Period up to Seventy-Five ($75) (the “Bonus Credit”). Bonus Credits will be applied the day following the Promotion Period (Monday, June 3rd). Bonus Credits may be used on all Casino games. Bonus Credits are not valid on sportsbook. Bonus Credit recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Bonus Credits received, regardless of whether the Bonus Credits, in whole or in part, is used. The Promotion Bonus value may be reported for tax purposes as required by law.

6. Registration Procedures

Eligible individuals must have an active PlayFallsview account in order to participate in this Promotion and verify your identity in order to play on PlayFallsview. Creating an Account at PlayFallsview or on the PlayFallsview mobile application is free. By submitting your information and creating a Casino Account, however, participants will be required to agree to the Privacy Policy (https://play.playfallsview.com/article/privacy-policy) and Terms (https://play.playfallsview.com/article/terms) . If you do not agree to Terms and Privacy Policy, you cannot create a Casino Account or participate in this Promotion.

7. Limitations on Participation

In addition to the eligibility requirements and limitations established in these Terms and Conditions—and in the general Terms and Conditions of PlayFallsview.com, Mohegan Digital, in its sole discretion not to be exercised unreasonably, reserves the right to refuse or otherwise restrict your eligibility to participate in any Promotion for any reason, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Promotion in good faith. This Promotion is void where prohibited by law. Limit of one (1) Promotion Bonus per person.

8. Wagering Requirements/Exclusions

The wagering requirement of 6x (six times) on casino must be met within seven (7) days in order to convert the bonus credits or bonus winnings to withdrawable funds. Wagering requirements refer to the amount of money players stake during the betting process, relative to the amount of the bonus – otherwise known as the amount rollover.

Example: If a player deposits a total of $200 and wagers $225 during the Promotion Period, they will receive a $50 bonus (25% of $200) on Monday, June 3rd. The player will then need to play through the $50 bonus six times, a total of $300.

9. Order of Funds Used for Wagering

When a bonus is issued, money for wagers is first taken from the restricted amount which is subject to wagering restrictions. Money is taken from the restricted deposit amount first, if any, before using the bonus money. Any winnings first replenish the bonus and the restricted deposit and are used next. Upon completion of wagering requirements, any restricted amount including winnings will be credited to player’s unrestricted account balance, and any subsequent wagers will be debited from the unrestricted account balance.

10. Eligible Games

Bonus Credits are eligible on all casino games. Bonus Credits are not valid on sportsbook.

11. Restriction on Withdrawal

The Bonus Credit is not transferable and cannot be substituted. Bonus Credit is non-withdrawable until wagering requirements established in Sec. 8 are met. Bonus Credit may only be used for wagering on your Account. Any unused portion of the Promotion Bonus will be automatically withdrawn from your Account seven (7) days after being credited to your Account. Deposited funds that have not been played may be refunded at any time.

12. Cancellation

Should you wish to cancel your participation in this Promotion at any time, please contact customer support at digitalcustomersupport@mohegangaming.com. Upon cancellation, you may withdraw any real money funds you have deposited into your account without restriction. However, you will forfeit any unused Promotion Bonus amount remaining in your account.

13. Gambling Problem

If you or someone you know has a gambling problem, help is available. Call 1-866-531-2600. All iGO gaming must occur exclusively within the Province of Ontario. MGE Digital Canada Inc. operates pursuant to an operating agreement with iGaming Ontario.

14. Other Additional Information

Administration: Mohegan Digital expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent. Administration of this Promotion is at the sole discretion of Mohegan Digital. Mohegan Digital reserves the right to restrict at any time any Casino Account holder from participating in this Promotion for any reason. Any questions relating to eligibility, these Terms and Conditions or any other questions concerning this Promotion will be resolved at the sole discretion of Mohegan Digital and its decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Promotion or reproduce or distribute any portion of these Terms and Conditions to their members.

Release and Waiver of Liability: By redeeming this Promotion, participants agree to release, defend, indemnify and hold harmless Mohegan Digital, its affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Promotion; and (ii) the receipt, use or misuse of the Promotion Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by Mohegan Digital’s own negligence. Mohegan Digital expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Promotion Bonus.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MOHEGAN DIGITAL SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE PROMOTION, EVEN IF FORESEEABLE OR EVEN IF MOHEGAN DIGITAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If any provision contained herein conflicts with the PlayFallsview.com Terms and Conditions, the provisions established in the Terms and Conditions of this offer shall prevail. No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
